- There are major changes as of right now that will impact all buildings in New York State built under the new 2025 Building Codes of New York. The biggest is the HEAT act, enacted by the New York State Legislature effecting use of fossil fuel will be banned December 31, 2025 and forward. This means fuel gas and propane powered heating, kitchen appliances and backup generators. This situation is in flux and may change as we get closer to the end of the year. Please do not get upset with the Code Department staff or Town Board, this is a directive authorized and placed into law by the New York State Legislature and Governor. We have a sworn obligation to uphold the State Codes through our Town Laws and State Laws. The only way fossil fuels may be installed after December 30, 2025 is if a valid building permit is in place by close of business on December 30, 2025 under the rules in the 2020 Building codes, and stays in effect until closed out. This also means any new gas service must be installed into the building under that permit by December 30, 2025. The fuel suppliers have their own timeline and rules, please follow them and they can let you know if it will be installed by the deadline.
